Regarding Provident Fund (PF), according to section 264 of BLA, 2006, a provident fund established for the benefit of its workers, if three-fourths of the total number of workers employed in it so that demand to the employer by an application in writing.
It is opined that, PF is not mandatory but depend on the employees demand and discretion of the management. Regarding Gratuity- ‘Gratuity’ means wages payable on termination of employment of a worker which shall be equivalent to not less than thirty days’ wages for every completed year of service or for any part thereof in excess of six months. So, it is mandatory.
